Dismissals - Unfair, Constructive or Wrongful

There are five reasons for which an employer can dismiss an employee.

If you have been dismissed for any other reason the dismissal may be unfair. As a result you have the right to bring a claim in the employment tribunal.

Equally if the correct procedures are not followed the dismissal may be unfair anyway.

In certain circumstances you may be considered to be ‘dismissed’ by your employer even when you resign from your position.
