Collaborative Family Law

This is an option you may wish to consider if you wish to avoid Court proceedings and to be more actively involved in discussions to try to settle matters.

What is meant by the Collaborative Process?

The Collaborative Process is an alternative way to assist you if you are separating or getting divorced during which you work with your solicitors to reach the best solutions for you and your family. Your solicitor will help you to resolve any issues in a constructive, non-confrontational manner.

What is needed for the Collaborative Process to work?

  • An agreement that you will reach a solution without going to Court.
  • A genuine desire by you, your partner and your solicitors to make it work.
  • A willingness to disclose information fully and honestly about all your assets. 
  • Both parties' solicitors have to hold Collaborative accreditation.


Benefits of Collaborative Process

  • You have your solicitor with you during the four-way meetings.
  • You remain in control of your own decisions without the threat of Court proceedings. 
  • Your solicitor is there to help you reach a settlement in a constructive way and will not be allowed to take the matter to Court. 
  • To assist in ensuring a better relationship between you and your partner for the future and it will hopefully help your children to cope better with the separation knowing that their parents have worked things out together. 
  • You remain in control of the decisions, rather than leaving such important issues which affect your future and those of your children to the Court. 
  • Consultants such as Mediators, Independent Financial Advisers, Accountants and others can be involved in the process where needed.
