Family Court Fees Set to Rise in 2025: What You Need to Know

Starting from 1st April 2025, the Ministry of Justice (MOJ) plans to increase 171 court and tribunal fees, pending approval by Parliament.

This change aims to keep pace with inflation, based on a 3.2% rise in the Consumer Price Index from March 2023 to March 2024. These increases are intended to help fund the much-needed improvements for His Majesty’s Courts and Tribunals Service (HMCTS), which has faced financial challenges, especially since fees have not been updated since 2021.

Why Are These Fees Going Up?

The proposed fee increases are designed to provide additional funding for HMCTS, enabling it to deliver better services and address the costs of running courts and tribunals where no fees are currently charged. While the impact on day-to-day court proceedings might not be immediately noticeable—due to the ongoing backlog and delays—these changes are necessary to support the system's long-term viability.

For many family cases, the focus will continue to be on Non-Court (Alternative) Dispute Resolution (ADR) methods, where appropriate, to ease the pressure on the courts.

Support for Those Who Need It

If you’re worried about the cost of these fees, the Help with Fees scheme is still available. This program assists individuals with lower incomes by offering full or partial fee remissions. You can apply for this support before your court application or even up to three months after paying the fee.

These changes may feel daunting, but there are still ways to ensure that everyone, regardless of financial situation, can access justice. Keep an eye out for any further updates as the new fees are implemented in 2025.
