Transparency in Family Law: A New Era for Reporting

28 January 2025

For years, family law proceedings in the UK have operated behind closed doors, shielded from public scrutiny. However, a significant shift is now underway: journalists and bloggers will soon have the ability to report on family law cases.

Starting from the 27th of January 2025, new changes to the Family Procedure Rules will apply in all family courts  across England and Wales. This significant development allows journalists and legal bloggers to report on what they observe during family court proceedings, provided a transparency order is in place.

This landmark decision aims to strike a balance between privacy and transparency, fostering greater trust in the legal system.

Historically, family courts have operated with stringent privacy rules, primarily to protect vulnerable parties—especially children. While this intention remains crucial, the lack of transparency has often led to accusations of secrecy, with some claiming the system is unaccountable or prone to bias. Opening the door for journalists and bloggers to cover these cases signals a commitment to addressing such concerns.

Under the new rules, journalists will have limited access to proceedings, and strict guidelines will still govern what can and cannot be published. Identifying details about children and families will remain protected, ensuring that privacy and dignity are not compromised.

This change is more than procedural—it reflects a cultural shift. It’s an acknowledgment that the public has a right to understand how justice is administered in some of society’s most delicate and emotional cases. By allowing responsible reporting, this move could help demystify the family court process, highlight good practices, and shine a light on areas in need of reform.

As this change unfolds, it will be fascinating to see how it impacts perceptions of family law and whether it can truly bring the transparency so many have called for while safeguarding the privacy of those involved. The balance will not be easy to achieve, but it is a step in the right direction.
