Court of Protection

Should an individual lose the ability to manage their own affairs due to a deterioration in their mental capacity and they do not have either a valid Enduring Power of Attorney or Lasting Power of Attorney in place, we can assist with an application to the Court of Protection for a Deputyship Order.

A Deputyship Order is an order granted by the Court of Protection appointing an individual to manage the affairs of a person who lacks capacity. This person may or may not be known to the individual.

The Court decides what decisions the Deputy may make including decisions ranging from the management of day-to-day financial matters to the sale of someone’s property and investments. The Court has full discretion as to the powers it grants to the Deputy

The Court further determines which level of supervision the Deputy is under. This can range from a very light approach to a far more onerous level of supervision, which will be determined by the Court. In most cases the  Deputy will have to provide an annual report to the Court of Protection detailing the financial status of the individual concerned.

We are able to assist not only with the application to the Court but members of our experienced team routinely act as the Deputy for a wide range of vulnerable people.

We can carry out whatever financial work is required including paying bills, providing cash for personal expenses, ensuring all benefits are claimed, monitoring capital and income, completing tax returns and so on. We are happy to liaise closely with family, carers and social services to ensure that at all times our work is in the individual’s best interests.
